US Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his return to the United States to face human smuggling allegations, he was detained in immigration custody.
In her order, the judge pointed out that the authorities lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
